1 Acceptance of Risk
By participating in a tour operated by us, you acknowledge and accept the inherent risks associated with travel, particularly self-guided activities, outdoor adventures, and travel in mountainous or remote regions. Your agreement to this clause is a condition of participation.
2 General Release of Liability
Except where loss, injury, or damage is directly caused by our reckless conduct, fraudulent behavior, or negligence, you release us from all liability for any:
- Economic loss
- Physical or psychological injury
- Illness (direct or indirect)
- Permanent disability or death
- Emotional distress
- Loss of services, economic support, or partner/spousal relationship
- Damage to or loss of property
We are not liable for such loss unless directly attributable to our negligence.
3 Assumption of Legal Responsibility
We will assume legal responsibility only when loss, injury, or damage is directly caused by our recklessness, fraud, or negligence, and in accordance with Taiwan law.
4 Exclusions of Liability
We do not accept responsibility for:
- Events beyond our reasonable control, including Force Majeure.
- Acts or omissions of suppliers or third-party service providers (see Clause 4).
- Losses not caused by our negligence.
- Special, indirect, or consequential loss, including loss of profit or business.
- Losses not reasonably foreseeable based on the information you provided.
- Services not included in our agreement (e.g., hotel-provided extra services).
- Losses not caused by our breach or negligence.
(viii) Natural and Wildlife Risks
Including but not limited to:
- Sudden weather changes
- Rockfall
- Altitude sickness
- Wild animal behavior
- Natural disasters
- Insects or pests (ticks, mosquitoes, bed bugs)
(ix) Client’s Personal Responsibility
You remain fully responsible for:
- Assessing your own fitness and ability
- Following local laws and supplier/guide instructions
- Judging the suitability of equipment and optional activities
- Managing pre-existing medical conditions and necessary medication
5 Limit of Liability
If we are found liable, the maximum amount payable to you shall not exceed the total price of your tour.
6 Indemnification
You agree to indemnify us for any loss, damage, or claims arising from the acts or omissions of you or any member of your party. If a third party seeks recovery from us due to your actions, you must reimburse us for any amounts paid, including fines or interest.
7 Self-Guided Travel Complaints and Remedies
(a) Obligation to Report Directly
For issues caused by third-party suppliers, you must promptly report the problem directly to the supplier (e.g., hotel management) to allow them an opportunity to investigate and provide a remedy.
(b) Written Notice Requirement
You must also submit a written complaint to us within [insert timeframe, e.g., 21 days] after the tour, detailing the issue and the steps taken with the supplier. Failure to comply with (a) may affect your ability to seek compensation from the supplier.
(c) Limitation of Our Responsibility
We act only as an agent for self-guided arrangements. We do not guarantee the outcome of remedy requests you make to suppliers, nor are we responsible for compensation related to supplier performance. All claims must be made directly to the supplier.
